My friends and I went to the Golden Light Cantina on 6th Street in Amarillo, Texas on August 10, 2009, and seated ourselves for dinner at about 7:15pm. Cliff Schragg, the manager approached me, tapped me on my shoulder, and told me I had to leave, saying that he was following the orders of Angela, the owner in telling me to leave. I said to my friends "I'm being told to leave let's go." As my friends and I were leaving, walking out the front door I asked the manager, "Why am I being told to leave?" He replied, "We don't let douche bags in here." With one foot practically out the door I looked back at him in the eye, and replied, "What are you talking about? There's a douche bag right there." Then I turned my head looking outside, continuing walking out the door when the manager then hit me in the back of my head, which caused me to begin falling to the ground, and my cowboy hat rolled down the sidewalk. When I fell to the sidewalk the manager continued punching on me as I held my right arm up to block those punches, and in my left hand I was holding my guitar case. After being punched by the manager several times in my head, and once in my nose, he continued beating on me me until I had moved forward off the side walk, and was lying down in a large puddle of water in the street, due to a heavy rain earlier that day, and my friend grabbed him, pulling him off of me, and telling him to stop, that enough was enough. Afterward, I immediately called the Amarillo Police Department, and when they showed up I filed a written complaint for assault against the manager.
On the evening of August 10, 2009, Dean was assaulted at the
by its manager, and Dean filed a written assault complaint with the Amarillo Texas Police Department. On August 10, 2009, Dean, while in Amarillo, Texas, received the following email from the Features Editor of the San Marcos Daily Record:

Then, Dean hitchhiked to Amarillo from Fairfield, Texas for his gig at The Lone Star Bar & Grill. On the morning of August 5, 2009, Dean gave an interview as scheduled to Buzz Russell on KNES 99.1 FM in Fairfield, Texas.

On August 1, 2009, while hitchhiking north on I-35 in Austin, Texas, Dean received a phone call from Paul Boggs, Vice President of Texas Campers On Mission, who booked Dean to perform at the fall rally at the Riverbend Retreat Center located at 1232-C County 411B In Glen Rose, Texas on October 3, 2009 at 7pm. Then, Dean hitchhiked to Fairfield, Texas from Johnson City for a radio interview with Buzz Russell at KNES 99.1 FM on August 5, 2009. On July 30, 2009, Dean performed as scheduled at The Friendly Bar Bistro in Johnson City, Texas. On July 29, 2009, Dean performed as scheduled at Faith Christian Cowboy Church in Johnson City, Texas. On July 27, 2009, while hitchhiking north on Highway 281 to Johnson City from San Antonio, Texas, Dean hitched a ride with Amalio Solis, and on their way they visited Cody Haynes, Pastor at Faith Christian Cowboy Church located at 1685 North US Highway 281 in Johnson City, Texas, and Dean got booked to perform there on July 29, 2009 at 7pm. Then, Dean hitchhiked to the Rio Grande Valley from Dripping Springs, Texas for his gig at Harley's Country Store & Beer Garden in Bayview, Texas. On July 11, 2009, Dean traveled from Johnson City to Dripping Springs, Texas where he performed as scheduled at a private party. On July 9, 2009, Dean performed as scheduled at The Friendly Bar Bistro in Johnson City, Texas, and afterward was booked to perform there again on July 30th & September 25, 2009 from 8-11pm. On July 9, 2009, while in Johnson City, Texas, Dean wrote his song:

On the morning of July 8, 2009, at Luckenbach, Texas, I asked to speak to Virgil Holdman Jr., the Luckenbach security guard about the fact that Tracy Thomas, the Luckenbach food vendor, in a hostile manner, refused to serve me the night before for an unvalid reason of his accusation toward  me of what he called identity theft. (I have stayed overnight with hundreds of strangers in my travels, and have always stayed on the up and up with those people, and I stayed overnight with him and his wife on June 22, 2009 in their home. On June 28, 2009, at 11pm., while I was staying overnight with a nice lady I met in Marble Falls, TX, the Luckenbach food vendor called me on my cell phone and started accusing me of what he called identity theft. During that phone call the food vendor said to me that he would get me fired from my gigs in the hill country, and that he would hunt me down, and for me not to underestimate him. Then the next morning I called the folks at Luckenbach, TX to tell them about the weird phone call I received from their food vendor. Then the food vendor called me again a little later on Monday morning, June 29, 2009, telling me to forget the whole thing ever happened, and I told him during that same phone conversation that I don't appreciate being threatened. Then during that same phone conversation the food vendor responded to me by telling me he doesn't make threats, he makes promises, and that if I don't want trouble don't start trouble. After that I immediately made a report of the weird phone calls to the Fredericksburg, TX police department.) The folks at Luckenbach stated to me that they had no opinion regarding the reported phone calls, though in my opinion they treated me very rudely, because of the reported phone calls. On the morning of July 8, 2009, Virgil, the Luckenbach security guard yelled at me that I was told before to stay away from the food vendor, which I had not been told before, and that if I told anyone at Luckenbach that the food vendor would not serve me food he would tell me to leave. Jimmy Lee Jones, the performer at Luckenbach that day, treated me rudely, and complained to the security guard when I asked him on the morning of  July 8, 2009, if the food vendor was talking bad about me. And because, Jimmy Lee Jones and those at Luckenbach were so rude to me, I booed his performance that morning, giving him a taste of his own medicine, and he didn't like it, and went to tell the security guard. While he was going to tell the security guard, a gentleman walked up to me, and asked me if I was going to play next. I answered that man's question saying, "They won't let me play, and they won't feed me, because the food vendor is accusing me of idently theft" with the audience and the security guard listening. The security guard then kicked me out, and I hitchhiked away.
On July 8, 2009, Dean was kicked out of Luckenbach, Texas, and from there he hitchhiked to Johnson City. Then, Dean hitchhiked to Luckenbach, Texas from San Antonio, Texas. On June 6, 2009, while in San Antonio, Texas, Dean received a phone call from a person who had seen him perform at the Friendly Bar Bistro in Johnson City, Texas on the fourth of July, and whom asked him to play at a private party in Dripping Springs, Texas on July 11, 2009, and he booked it.
While hitchhiking out of Marble Falls, Texas, Dean sold a Hitchhiking Guitarman CD to someone with whom he hitched a ride (name unknown). On July 5, 2009, Dean hitchhiked as far as San Antonio, Texas from Marble Falls, making his way towards the Rio Grande Valley, and received a phone call from Ed Thompson, the Manager of the Friendly Bar Bistro in Johnson City, offering Dean a gig there on June 9, 2009, and Dean booked it. Then, Dean began hitchhiking to the Rio Grande Valley to perform at Harley's Country Store & Beer Garden in Bayview, Texas on July 17, 2009. On July 5, 2009, Dean spoke on the phone with Debbie, the manager of
located at 935 E FM 1151 in Amarillo, Texas, and got himself booked to perform there on August 13, 2009 at 7pm. On July 5, 2009, Dean hitchhiked to Marble Falls, Texas from Johnson City, and performed as scheduled at The R Bar & Grill. On July 4, 2009, Dean performed as scheduled at the Friendly Bar, and the Spange Dangle festival and parade.

Then, Dean hitchhiked to Houston from Del Rio, Texas to be a guest on Nightsounds with Pat & Rosie on KPFT 90.1FM on June 13, 2009. On June 3, 2009, Dean performed as scheduled at The Buzzard Roost Saloon. His second day in Del Rio, Dean walked into The Buzzard Roost Saloon located at 4411 Veterans Blvd. where he spoke to and performed a live audition for owners, M.J. and Monty,  and got  himself booked to perform there on June 3rd & July 22, 2009 at 7pm.  Then, Dean hitchhiked to Del Rio, Texas from San Antonio. On May 29, 2009, Dean performed as scheduled at Elena's Los Pinos Mexican restaurant, and the VFW Post 76 in San Antonio, Texas. On the morning of May 29, 2009, Dean walked to the

Then, Dean hitchhiked from Austin to San Antonio, Texas. Then, Dean hitchhiked from San Antonio to Austin, Texas where on May 27, 2009, he purchased a brand new DELL INSPIRON laptop computer from Best Buy. On May 23, 2009, Dean performed as scheduled at The View Tequila Bar in San Antonio, Texas. On the morning of May 22, 2009, Dean walked into Elena's Los Pinos #2 Mexican restaurant in San Antonio for breakfast, and was booked to perform later for the lunch crowd, which he did gladly. On May 19, 2009, Dean was booked, through his Never Die Records Myspace.com website, to play during the Honky Tonk Happy Hour at Sam's Burger Joint in San Antonio, Texas on September 18, 2009. On May 16, 2009, Dean performed as scheduled at Sundance Square in Fort Worth, Texas, and during that performance he was filmed by Donny B  playing "Whiskey River" for

Channel 24. Dean sold a Hitchhiking Guitarman CD to the following people from whom he hitched a ride from Spicewood, Texas to Fort Worth, Texas: Amanda Janinte' Hill and Chuck Wiedenhoefer. Then, Dean hitchhiked to Fort Worth, Texas from Spicewood, Texas for his gig at Sundance Square. On May 10, 2009, Dean and Henry McCall made a trip to Poodie's Hilltop Roadhouse in Spicewood, Texas where Dean performed his song "That Very Sad Sixth Day Of May (At Poodie's Hilltop Roadhouse)" during a tribute to Poodie.

Since you told me I'm supposed to look like I'm busking I wish to continue to accept the strolling musician gigs that the Union can offer me. Regarding the Main Street Arts Festival I will go in the middle of the intersection and perform to draw a crowd, and wish to accept that gig again if the Union can offer it to me. Please accept my withdrawal. I apologize for any inconvenience if caused by my letter of resignation.

Further to our telephone discussion this afternoon, I confirm the outline of our agreement to settle and dismiss the case captioned Ronald Dean Strickland d/b/a Never Die Records v. Saint Joseph's University, Docket No. 2114-SC (Small Claims Court, Precinct No. 2, Montague County, Texas).  In return for your agreement to dismiss the case and release Saint Joseph's University (SJU) from liability for past actions, SJU has committed not to use any designation containing "Never Die Records" including, without limitation, "Never Die Records," "Hawk Will Never Die Records," and "The Hawk Will Never Die Records."  Although SJU will take immediate steps to cease use of all designations containing "Never Die Records," SJU commits to have completely changed to a new designation within six months at the most.  You will be free to announce, on your website and elsewhere once a settlement agreement is signed and the case is dismissed, that SJU agreed to stop using any designation containing "Never Die Records."

Please confirm, by return email, your agreement to the above outline as an accurate summary of the settlement terms we discussed.  I will then draft a short settlement agreement, including as an attachment a document to be filed with the court dismissing the case, and forward it to you for signature. 

Meanwhile, so as not to risk a default judgment, SJU's Texas counsel, Mr. Fredricks, will file an answer to your complaint.  That action will give us a week or two to finalize settlement and avoid troubling the court with unnecessary proceedings.

When I first noticed Saint Joseph's University using the name 'Never Die Records' in September 2007 I requested that they cease to use the mark I have continuously used, and have filed as a fictitious business name / DBA on August 27, 2002 a sole proprietor of 'Never Die Records'. Approximately over a year later Saint Joseph's University began using the name 'Hawk Will Never Die Records' playing on the name 'Never Die Records'. Saint Joseph's University claims they have "done nothing wrong". My suit is for trademark infringement.

Because of the enclosed printed copy of an email I received from Kevin Casey on behalf of Saint Joseph's University, I, Dean Strickland of Never Die Records give notice of the filing of a Small Claims Suit against Saint Joseph's University for trademark infringement. 'Never Die Records' says 'Hawk Will Never Die Records', playing on the name 'Never Die Records' allows for the use of keywords on the internet to misdirect those who are searching for 'Never Die Records'. $10,000 is the amount to be sued for, and if the money is not received within 10 days of the date of the receipt of this letter suit may be filed. You, representing the defendant, Saint Joseph's University, upon the reading of this letter have received notice of the suit.

The company record label 'Never Die Records' was first started by Ronald Dean Strickland in the year 2002 as student at Musicians Institute in Hollywood, California, when he created it as a music business class assignment. Dean Strickland used the trade name 'Never Die Records' in commerce as early as July 2002, thus establishing a trademark at that time. Strickland continuously used the mark thereafter, and on August 27, 2002, as the sole proprietor, filed it as a fictitious business name doing business as 'Never Die Records' with the Los Angeles Registrar-Recorder/County Clerk. The real 'Never Die Records' was founded by Dean Strickland several years before the defendant created its record label 'Never Die Records' and then later its 'Hawk Will Never Die Records' playing on the name 'Never Die Records'. Dean Strickland's distinctive mark 'Never Die Records' is thus entitled to legal protection. I, Dean Strickland warned the defendants not to infringe my mark and to cease and desist.
